DISTANCE AGREEMENTThis agreement is made between SIA “EKOSAN”, unified reg. No. 40003984154, legal address: Zolitūdes iela 79, Riga, LV-1029 (hereinafter referred to as the Seller), and a natural or legal person (hereinafter referred to as the Buyer), who places an order or purchases goods in the online store.www.bioss.lv.

  1. General terms

1.1. Placing an orderwww.bioss.lvThe buyer confirms that they have read these Terms, the Privacy Policy, and agree to them.1.2. Distance contract – an agreement between the Buyer and the Seller, concluded remotely using distance communication means (online store), which defines the rights, obligations, and responsibilities of the parties.1.3. The seller cannot guarantee that the online store will operate continuously, without errors or interruptions. The seller has the right to temporarily suspend the operation of the store for technical reasons without prior notice.1.4. The buyer agrees not to disrupt the operation of the online store and cannot raise complaints about temporary system malfunctions.

  1. Registration and Buyer Responsibility

2.1. The buyer can place an order both as a registered user and as a guest.2.2. The Buyer is fully responsible for the accuracy of the data entered in the order form. If the Buyer has provided an incorrect delivery address, phone number, or parcel terminal, the Seller is not responsible for the non-delivery of the goods or delays in delivery.2.3. The buyer is responsible for the security of their login data (username and password).

  1. Products and prices

3.1. The prices of visas in the online store are indicated in EURO (EUR) and include value-added tax (VAT). Delivery costs are not included in the price.3.2. The seller has the right to change prices without prior notice. The price for orders that have already been placed and paid for will not be changed.3.3. The seller ensures that the product images and descriptions are as accurate as possible; however, considering monitor differences and packaging changes made by manufacturers, the actual product may differ slightly from what is shown in the image.3.4. The Seller has the right to cancel the Order if:3.4.1. The buyer has not made the payment within the specified term;3.4.2. The item is no longer available in stock (in this case, the Seller offers a comparable item or refunds the money).

  1. Payment procedure

4.1. The buyer will pay for the goods in advance using:4.1.1. Internet bank or bank payment card online;4.1.2. Bank transfer after receiving the invoice.4.2. The order is prepared for shipment only after the full invoice amount has been received in the Seller’s bank account.

  1. Delivery and Temperature Regime

5.1. The goods are delivered in the manner chosen by the Buyer: Omniva or Latvijas Pasts parcel machines.5.2. Delivery costs are calculated and displayed in the shopping cart before payment is made.5.3. Important about temperature: When choosing delivery to outdoor parcel machines, the Buyer should take into account the weather conditions (frost in winter, heat in summer). Many bio products, oils, cosmetics, and dietary supplements, etc. are sensitive to temperature fluctuations.5.4. Buyer’s responsibility: The Buyer assumes responsibility for the preservation of the product’s quality if they choose delivery to an outdoor parcel locker in extreme weather conditions. The Seller does not compensate for damages (such as freezing or melting) that occur if the Buyer does not collect the shipment from the locker in a timely manner.5.5. Upon receiving the goods, the Buyer’s obligation is to visually assess the packaging. If external damage is detected, the Buyer has the right to refuse the shipment or to immediately inform the Seller by sending photographs.

  1. Right of withdrawal and product returns

6.1. According to the regulations of the Cabinet of Ministers of the Republic of Latvia No. 255, the Buyer (consumer) has the right to withdraw from the goods within 14 (fourteen) days from the moment of receipt, without stating a reason.6.2. To exercise the right of withdrawal, the Buyer must send a completed withdrawal form or a free-form application to the email: bioss@bioss.lv6.3. The buyer is obliged to return the goods to the seller within 7 days after sending the cancellation.6.4. Refund: The Seller will refund the money received for the goods (including the cheapest delivery method) within 14 days from the moment the Seller has received the returned goods and verified their condition.6.5. Exceptions (items that cannot be returned):6.5.1. Products that are perishable or have a short shelf life;6.5.2. Hygiene products: Cosmetics, dietary supplements, hygiene accessories, if their packaging is opened (not in the original packaging, protective film removed or seal damaged). Such products are not accepted for return due to health and hygiene considerations.6.6. The buyer covers the direct costs of returning the goods (postal or parcel locker expenses), except in cases where the product has a manufacturing defect.

  1. Product quality and warranty

7.1. The buyer has the right to submit a claim for non-compliance of the goods with the terms of the contract within 24 months from the date of receipt of the goods (Consumer Rights Protection Law).7.2. If a manufacturing defect is found in the product, the Buyer sends a request and a description of the defect to /foto at[IEVIETOT TAVU E-PASTU].7.3. In the case of fundamental claims, the Seller will rectify the defects of the goods free of charge, exchange it for a new product, or refund the money.

  1. Personal data processing

8.1. The personal data provided by the buyer is processed in accordance with the Personal Data Protection Law and the requirements of the GDPR.8.2. The data is used only for order fulfillment, accounting purposes, and communication with the Buyer. Detailed information is available in the “Privacy Policy” section.

  1. Dispute resolution

9.1. Any disputes between the Buyer and the Seller shall be resolved through negotiations.9.2. If an agreement cannot be reached, the Buyer has the right to contact the Consumer Rights Protection Centre (PTAC), address: Brīvības iela 55, Riga, LV-1010, or to go to court in accordance with the procedures established by the laws of the Republic of Latvia.
